The 38-year-old man who was the focus of a manhunt by police after the Monday abduction of 4-year-old Louisiana, Mo., girl pleaded guilty in 1995 of sexual assault, the Waynesville Daily Guide has learned.
Paul S. Smith, 38, allegedly abducted Alisa Maier, 4, from her Louisiana, Mo., home about 8 p.m. Monday. He released her 26 hours later at a car wash in Fenton, Mo., then fatally shot himself about 4:30 p.m. Wednesday as police neared his home in Hawk Point, Mo., in Lincoln County.
Smith's cabin in Hawk Point is 97 miles from St. Robert. Louisiana is 128 miles from St. Robert.
According to documents obtained by the Waynesville Daily Guide, Smith pleaded guilty on April 6, 1995, to two counts of felony sodomy through a plea agreement in the case filed in Phelps County but prosecuted in Pulaski County on a change of venue.
The court documents indicate Smith committed the acts between March and April 1994.
In his petition to enter that guilty plea on April 6, 1995, Smith, then of Rolla, admitted to intercourse, full well knowing the partner was a minor.
“I had anal intercourse with (blacked out) when he was less than 14; I performed anal sex on (blacked out) when he was less than 14,” Smith writes in the plea agreement obtained by the Daily Guide. The boy allegedly was 10 years old at the time.
In that case, Smith's willingness to plead guilty to two concurrent 15-year sentences was revealed. For that guilty plea, the prosecutor, Patrick L. King, agreed to dismiss charges Smith allegedly had relations with five others.
“The prosecuting attorney promised that if I plead guilty, he will do the following: Recommend two 15-year sentences, concurrent; to dismiss (Case No. R-594-1043FX) and not to prosecute me for any other alleged sex crimes committed against (blacked out), (blacked out), (blacked out), (blacked out) and (blacked out).”
Meanwhile, officials are continuing to ballistically investigate whether the shooting death of a garage owner in Hawk Point is connected to Smith.
In their investigation Thursday of Smith's Lincoln County home, police are hoping to determine by today whether the gun that Smith used to kill himself is the same that killed garage owner Jefferey Smith.
Jefferey Smith, 49, was found fatally wounded outside Smitty's Garage on Highway A at about 11:30 p.m. Saturday. He died of a single gunshot wound to the head a short time later. Jeffery Smith is not related to Paul Smith.
In November 2009, Paul Smith robbed another auto shop in Hawk Point, taking a cash register, expensive electronic diagnostic equipment and a 2005 Chevrolet Impala. Smith pleaded guilty to charges of tampering and receiving stolen property in that case. Smith was sentenced to five years in prison, but the execution of the sentence was suspended, and he served 120 days of shock time instead.
Since Paul Smith was linked to Alisa Maier's abduction residents in Hawk Point have questioned whether he was linked to the death of Jefferey Smith and a string of recent burglaries in the area.
